JOB POSTING #: 2021-0347 POSTING PERIOD: Thursday, October 14, 2021 at 8:30am to Wednesday, October 20, 2021 at 4:30pm DEPARTMENT: Provincial Offences UNION: Non-Union POSITION STATUS: Temporary Full-Time # OF POSITIONS: 1 RATE OF PAY: $86,244.13- $104,830.80 per year SHIFT WORK REQ'D: No DUTIES: Reporting to the Lead Prosecutor, this position will be responsible for conducting prosecutions under provincial statutes and certain federal statutes and municipal bylaws in the Ontario Court of Justice including reviewing statements of witnesses and admissibility of evidence; Preparing prosecution cases, researching relevant case law, interviewing witnesses and providing advice to police and other enforcement agencies; Participating in disclosure and resolution proceedings; Presenting oral and written legal arguments before Justices of the Peace pertaining to Part I, II and III matters under the Provincial Offences Act of Ontario and under the Contraventions Act of Canada; Assisting various enforcement personnel in preparation of offence notices and information and reviewing same; Conducting appeals and reviews of matters dismissed or quashed; Performing other legal duties as assigned including civil enforcement of outstanding fines, appearances before various courts and tribunals, preparation of legal documentation and process. The successful applicant will be employed by the City of Windsor pursuant to an Inter-municipal Service Agreement with ten (10) local municipalities in consequence of the POA Transfer initiative of the Ministry of The Attorney General. Will perform Occupational Health & Safety duties as outlined in the Corporation’s Health and Safety Program. Will perform other related duties as required. The applicant will primarily work out of the main Windsor POA Court facility, with rotational travel to the Leamington satellite court. QUALIFICATIONS: Must have LLB, JD or an Ontario Ministry of Education equivalency and a minimum of four (4) years post-call experience (emphasis on Provincial Offences Act prosecutions will be considered an asset). Must be in and maintain good standing with the Law Society of Upper Canada; Must have the ability to travel to off site locations in a timely and expedient manner as required. If method of travel is by vehicle, a current valid and lawful driver’s licence is required in accordance with the Highway Traffic Act. Must be fully computer literate and well versed in the MS Office suite, particularly Outlook and Word (Excel and Access skills will be considered assets). Must be able to effectively use Westlaw@Carswell and Internet resources for legal research. Must have proven communication, analytical, interpersonal, and research skills, as well as the ability to establish and maintain effective relationships with City representatives, enforcement personnel, other agencies and the general public. Must be conversant with all aspects of judicial system and be able to interact with judiciary, prosecutors and defence counsel. Must have and retain use of a motor vehicle for attendances at Leamington satellite court. Bilingual in French would be considered an asset Should have knowledge of the Occupational Health and Safety Act, its regulations and knowledge of the hazards associated with the work. The physical demands analysis associated with this job indicates a sedentary level of work.
